The face of a child rapist, Orlando Paul Cisneros
A child that just turned 14 6 days prior to a rape
from a 38 year old Orlando Paul Cisneros, and her family is NOT getting the
justice they deserve. Because she was 14, and not 13, Shawnee County
Judge Matthew Dowd sentenced him to 3 years probation, instead of the
suggested 13 years behind bars that his 17 counts of felony would usually
dictate. Even with him sodomizing and raping her, building a sick and
twisted relationship with her, being found guilty of 17 felony counts, this
child rapist is free today. This with a child barely 14!!! Every
parents worse nightmare has come true here.......... and yet justice
has yet to be served.
Judge Matthew Dowd also went lightly on another
sexual predator (Fredrico Mendoza) who was very sexually explicit with a 13
year old ID via internet, and when he did arrive at what he believed to be
her house on Aug. 10, 2006, he was arrested immediately. He brought
items with him such as condoms, a dildo, sexual lubricant, a video camera,
etc.

Other child predator Judge Matthew Dowd let go on
probation only, Fredrico Mendoza.
He was charged with several crimes in connection
with what he attempted to do to a young child, and on Thursday Aug. 17,
2006, Fredrico Mendoza was indicted by a grand jury for these attempted
crimes against a child.
He could have been sentenced to 12 years in prison.
Instead, Judge Matthew Dowd ruled that he be put on probation. What
message is this Judge sending out to sexual predators in Kansas? In
the US? What message is he sending out to the victims?
Dowd said he parted from the sentencing guidelines
for Orlando Paul Cisneros based in part of Cisneros having 'massive
depression' at the time of his alleged crimes and noted Cisneros is being
treated with medication and psychiatric therapy.
The Judge also said Cisneros had shown a history of
having steady employment.
"I felt he had a good chance of rehabilitation,
based on family support," Dowd said. "Plus, I felt there was no
permanent, severe damage to the victim. She said that, too."
As part of his probation, Cisneros must continue
with his psychiatric treatment and medication and can't have contact with
the victim.
Meanwhile, this leaves the child of 14 knowing that
her rapist is free, knowing that he did NOT go to jail like he should have,
and having a life time of healing ahead of her. It leaves her family
without justice, and with the knowledge that their daughters rapist is not
behind bars and is now free to rape another young victim. (He already has,
and that information will be shared more later).
Do your part; write, e-mail, do what you can to
show that this type of sentencing is NOT what we expect for a child rapist!!
Demand that Shawnee County Judge Matthew Dowd be removed from his position
immediately, and for this case to be put on emergency appeal (an appeal has
already been filed, but can take up to a year or more to be reviewed).
Also, demand that Chief Judge Nancy Parrish explain her actions of backing
up and supporting the Judge that would issue such incomprehensible immoral
rulings. This family needs justice, this victim needs closure, and
they need your help!!! Pass this information on if this OUTRAGES you,
pass it on to those that have children, to those that care. This is
something that we should NOT condone, and we need to take action now!
Let's help bring justice to this girl and her family!

factors and arguments of counsel, the Court pronounces the following
sentence: The Court finds the defendant's criminal history
classification is I. Allocution offered to the defendant.
Sentenced to custody of Se. of Corrections as follows: Ct 1 a term
of 59 months; and Ct 2 a term of 59 months concurrent; and Ct 3 a
term of 59 months concurrent; Ct 4 a term of 59 months concurrent;
Ct 5 a term of 59 months concurrent; Ct 6 a term of 59 months
concurrent; Ct 7 a term of 59 months concurrent; Ct 8 a term of 59
months concurrent; Ct 9 a term of 59 months concurrent; Ct 10 a term

Orlando Paul Cisneros,
age 38, whose last
known address was 1604 SW Shunga, Topeka, Kansas, was convicted today,
following a jury trial, of one count of Rape of a 14-year old girl who was
incapable of giving consent because of the effects of liquor, drugs and
other substances, and multiple counts of Aggravated Criminal Sodomy;
multiple counts of Criminal Sodomy; and multiple counts of Aggravated
Indecent Liberties with a Child. These offenses all
occurred in October of 2006 and occurred over a period of approximately 1
month.
The Defendant in this case was 38 years of age and the victim 14
years of age. The conviction of the charge of Rape in
this case is a Level 1 person felony with a sentencing range of 147 to 653
months depending on the Defendant's prior criminal history.
Aggravated Criminal Sodomy is also a Level 1 person felony.
Aggravated Indecent Liberties with a Child and Non-Aggravated
Criminal Sodomy are all Level 3 person felonies which carry a penalty of 55
to 247 months, depending on the Defendant's criminal history.
The State will ask that at least the two Level 1 person felonies
sentences run consecutive to each other with the Level 3 person felony
sentence running concurrent.
This case was prosecuted by Assistant District Attorney Dan Dunbar.
The primary detectives in the case were Detective Daryl Ludolph of the
Topeka Police Department and Detective Dustin Carlat of the Shawnee County
Sheriff's Office. This investigation is an example of
quality law enforcement and cooperative investigations.

THE COURT: All right.
Well, I can certainly appreciate that there is a strong difference of
opinion as to what an appropriate sentence should be, and what the Court
should do.
In
my judgment-- and I'm the one that has to take responsibility for this--
but, in my judgment, the defendant through counsel and through is medical
expert has provided the Court with substantial and compelling reasons to
depart of a durational-- well, not of a durational, but of a dispositional
judgment.
I
agree that the defendant has some positive things going for him, and some
things that make this situation, although on paper is horrible, horrible, I
think that it falls really in the category of a very great, and very
disastrous lack of judgment on his part, and a failure of being able to, for
whatever reason, to act as a mature individual. I give attention to
the things that the defendant has pointed out, the family support, the
economic stability. I think the depression was a major factor in this
situation. I do believe that the defendant's intent was less serious
than it would otherwise be because of the circumstances that he was in and
because of the situation that he found himself in. So, I am going to--
I am going to depart for the reasons suggested by the defense.
I
am very appreciative of the harm and the difficulties caused by the
defendant's actions to the victim and her family. However, the victim,
I'm very much persuaded by B's comments. She is, I think thankfully
for everybody involved in this, not seeking any kind of vengeance, not
seeking any kind of ill will towards the defendant herin. I think
that's important to me and it's important to the appropriate disposition of
the case.
So, I am going to sentence the defendant to the medium range on the
sentencing guidelines. I will go through them count by count. 155 on
the rape charge; 117 on the sodomy; 117, again, on the other sodomy; 117
again, on the sodomy; 59 on the sodomy; 59 on the sodomy; 59 on the sodomy;
59 on the sodomy; 59 on the sodomy; 59 on the sodomy; 59 on the sodomy; 59
on the sodomy; 59 on the sodomy; 59 on the sodomy; 59 on the sodomy; 59 on
the sodomy.
My
intent is to impose the mid-range on all of those counts. I'm going
rung those counts concurrent, one with the other. I believe that this,
although they were separate acts, I believe that this was on basic
transaction, and I think concurrent sentences are warranted under the
circumstances. I'll suspend those. And the post-release
supervision would be 36 months. I'm going to suspend those sentences, and
place the defendant on intensive supervised probation to Community
Corrections for 36 months.
I'll require that he continue to be involved in psychological counseling.
I'll require that he continue the medication as previously indicated.
The costs in this case are $163, probation fee is $50. Defendant will be
required to do DNA testing. I have attorney fees of $4,000, I'll
impose that. I will waive the application fee.
Mr. Cisneros, are you willing to accept probation under these terms and
conditions?
DEFENDANT CISNEROS: Yes, sir, I am.
THE COURT: Okay. Either side will have the opportunity to appeal
within ten days. Defendant will be allowed to have assistance for
procurement of counsel to process the appeal if that's appropriate.
I'll also impose the jail sanctions that are customary for Community
Corrections imposition by the probation officer.
MR. DUNBAR: Restitution be open for 30 days?
THE COURT: Restitution will be allowed.
MR. DUNBAR: And the defendant be required to register as a sex
offender?
THE COURT: Defendant will be required to register as a sex offender.
That will be the order of the Court.

It’s been a rough several weeks for Tanya West.
At first, she was concerned about what she would tell
her two boys about their father being sent to prison. But now that Orlando Paul
Cisneros has walked free, that’s changed.
“I thought he was going to prison for a long time and
come to find out, he gets out,” said West. “I wasn’t expecting that at all.”
Cisneros was found guilty of repeatedly raping and
sodomizing a 14-year-old girl.
Shawnee County Judge Matthew Down sentenced him to
three years probation, instead of the suggested 13 years behind bars. There’s
been national outrage about his decision.
Now, West said she fears for the safety of her two
children. Cisneros fathered the boys. West said Cisneros was her boyfriend for
eight years. Now, the two are in a custody battle.
Cisneros requested time with the children, who are 3
and 7, on Father’s Day. But, he was ordered to stay away from them until a
custody hearing Friday.
“There’s concern with him exposing my children to
inappropriate things, him kidnapping my kids, there’s several concerns,” said
West. “I believe he not only could do it again, but I worry about my safety, I
worry about my children’s safety.”
But, the ultimate decision about Cisneros’ parental
rights will be up to a judge.
West said she hasn’t told the children their father is
no longer behind bars. She said they’re too young to understand.
We’ve tried several times to make contact with Cisneros
and his lawyer for comment, but haven’t been successful. We’ll keep trying.

A Topeka woman says she fears for the safety of her two
children tonight. Their father walked free after he was found guilty of

A 38-year-old man charged with multiple counts of sexually
assaulting a younger teenage girl waived a preliminary hearing on Tuesday.
Orlando Paul Cisneros is charged with six counts of
aggravated indecent liberties with a child 14 to 16 years old and 10 counts of
criminal sodomy with a child 14 to 16 years old.
Cisneros remains in jail in lieu of a $200,000
professional surety bond, according to court records.
Cisneros is scheduled to appear before Shawnee County
District Judge Matthew Dowd on Nov. 11, when the judge will arraign Cisneros on
the 16 felonies.
The victim, a 14-year-old girl, and several supporters
were in the courtroom Tuesday during the proceedings.
Cisneros was arrested on Oct. 10. The investigation
began when a school resources officer received information from students that a
14-year-old girl, who was a runaway, was having a sexual relationship with a
38-year-old man.
An investigation by the officer and Topeka police
detectives showed the relationship started when the girl was younger than 14.
The assaults didn't occur on school property, police
earlier said, and Cisneros isn't employed by or otherwise associated with the
schools.

O'Reilly tackles Dowd's rulings

Talk show host Bill O'Reilly applied spin Monday to
controversy in Topeka sparked by a Shawnee County District Court judge's grant
of probation to three men guilty of child sex crimes.
O'Reilly offered a blistering critique of District
Judge Matthew Dowd during interviews on Fox News television with the father of
one victim of sexual assault and with the host of a Topeka radio show.
"I'm just furious right now," O'Reilly said. "This Dowd
guy, if I could get him out of there in any way shape or form, I'd get him out
of there."
O'Reilly focused on the sentence of three years of
probation given to Orlando Paul Cisneros, 38, who was convicted in February by a
Shawnee County District Court jury of 17 felony counts of raping and sodomizing
a 14-year-old girl in 2006.
Under state sentencing guidelines, Dowd could have
ordered Cisneros to serve 13 years in prison. The judge ordered probation
because Cisneros was suffering from depression at the time of his crimes and had
a good chance of rehabilitation through therapy.
O'Reilly also criticized Dowd for granting probation in
two other recent cases involving sex offenders.
Dowd wasn't interviewed by O'Reilly, but video of him
entering his car and driving away from a business was broadcast. Dowd declined
to comment Monday night when contacted by The Topeka Capital-Journal.
Michael Burlison, father of the teenager assaulted by
Cisneros, said on the show Dowd's ruling "absolutely stunned" the family.
"This man was found guilty of these 17 felony counts by
a jury of his peers during a week-long trial," he said.
"This makes me sick," O'Reilly said.
Burlison said his daughter was traumatized by the abuse
and by knowledge her attacker was set free.
"We fear for her safety," the father said. "We also
fear for the other potential victims out in the community."
O'Reilly linked his anger for Dowd with concern about
Wichita doctor George Tiller, who has been accused by O'Reilly of performing
improper late-term abortions. Tiller is under investigation by Attorney General
Paul Morrison.
"People are going, 'What the heck's a matter with

Megan Mosack, a talk show host on WIBW AM 580, said
callers to her program posed the same question in relation to Tiller and Dowd.
"Kansans are wondering," she said. "Apparently, in
Kansas, we have a real problem protecting children."
Under Kansas law, Dowd could be removed at any time by
the Kansas Supreme Court if in violation of an ethical code of conduct. Dowd is
up for a retention vote in 2008, but he plans to retire before the election.
"He shouldn't serve another single day," O'Reilly said.
State Rep. Joe Patton, R-Topeka, announced Monday he
would conduct a series of meetings to discuss possible reforms of state
sentencing guidelines. The first session is 1:30 p.m. June 26 in Room 423-South
in the Capitol. Shawnee County District Attorney Robert Hecht is expected to
attend.
"The current guidelines have allowed criminals to walk
the street and to prey on the poor, the weak, the innocent and the elderly, and
it's time we did something about it," Patton said.

Community outrage after a Shawnee County judge lets a
convicted child rapist walk free has caught the attention of the O'Reilly
Factor.
Monday night, Fox News host Bill O'Reilly interviewed
the father of that 14-year-old rape victim.
And Fox News tried to pin-down Judge Matthew Dowd.
During the sentencing, Judge Matthew Dowd stated, "I do
believe that the defendant's intent was less serious than it would otherwise be,
because of the circumstances that he was in..." The judge then gave Cisneros
just three years probation.

Dozens of people lined up outside the Shawnee County
Court House holding signs in support of a young rape victim and demanding
answers from the judge that let her offender walk free.
The victim's father is still struggling to make sense
of the ruling.
"There is just too much anger and frustration on my
part and really there is nothing that man can say at this point to ease my
mind," Mike, the victim's father, said.
Even the victim herself is speaking out. We blurred her
face because 49 News does not identify rape victims.
"He did the wrong thing," she said.

When asked if she would like to see Judge Dowd step
down, protester Emma Cunningham said, "Yes." How soon? "Yesterday," she said.
"I think that's the best thing that could happen," said
"Ace", a member of Bikers Against Child Abuse. "Personally, I think the judge
should take the sentence for him."
Judge Matthew Dowd gave Orlando Paul Cisneros three
years probation instead of the suggested 13 years behind bars, stating during
Cisneros sentencing that the offender's actions were a disastrous lack of
judgement and failure to act as a mature individual.
He went on to say his decision took into account the
defendant had positive traits, like family support and economic stability, an
excuse painfully unacceptable to the victim's family and supporters.
"Where was his family support when he was raping and
molesting my daughter?," Mike asked.
But as the family waits for the sentence to go through
appeals...
"We feel we've been victimized not only by the
perpetrator, but also by the judicial system," Mike said.
"It feels like they're out here for a good cause," said
the victim.
...they say there is some sense of healing with so much
community support.
We tried to contact Judge Dowd but were not able to
reach him.
The state is appealing the sentence, but that process
can take a year, maybe more.

A departure from sentencing guidelines has another
Shawnee County District Court Judge facing criticism. Protestors stood
outside the Courthouse Thursday, angry, over Judge Matthew Dowd’s decision
last month to sentence a man convicted of raping a minor to 3 years
probation.
These protestors are letting their signs speak for them and hoping Shawnee
County judges get the message.
"Let them know that they're appointed and they've been gifted their jobs
from years of service and now it's time to show they deserve to keep their
jobs," says Monica, protest organizer.
This protest centered around 14-year-old Brandi Burlison, the victim of
38-year-old Orlando Paul Cisneros, who was sentenced to 3 years probation in
May for rape, sodomy and indecent liberties against Brandi. She shows her
face Thursday to help others.
"This is her choice. She wants to speak for victims, children who might not
have to go through this because judges will put sex offenders behind bars.
Because if they let them out on probation, it's going to happen again," says
Tina Burlison, victim's mother.
"If they deserve to go to jail, then send them to jail. I think this case
was unfair because he should've gone to jail," says Brandi.
Through therapy she is recovering, but says Judge Dowd’s decision has left
her with fear.
"Now I'm scared because he's out. He could be around the corner, you never
know," says Brandi.
She says the judge justified the probation because Cisneros was depressed,
sending a bad message to criminals.
"That it's okay to do this, just say you're depressed and you can get out of
jail because that's what happened here," says Brandi Burlison.
"Judge Dowd also said that he had steady employment, well so did the BTK
killer, what’s his point?" says Monica.
Even District Attorney Bob Hecht has called Judge Dowd’s decision
"incomprehensible" and Hecht’s daughter was at Thursday’s protest. Now
Hecht’s office is filing an appeal to Judge Dowd’s decision.
When the crime occurred Brandi Burlison had just turned 14. Had it happened
6 days earlier, when she was still 13, Cisneros could've been sentenced to a
mandatory 25 years under Jessica’s Law.

A Shawnee County judge has let a convicted

silent protest is in response to a decision handed down by District Court Judge
Matthew Dowd. On May 25th, Dowd granted probation for Orlando Paul Cisneros, 38.
Cisneros was convicted on 17 charges of rape and sodomy involving a 14-year-old
girl. Had Dowd followed state sentencing guidelines, Cisneros could have served
13-years in prison.

The victim's parents want the judge to step down
immediately and they hope the community will continue to stand behind them as
they demand justice.
When Mike and Tina first heard the sentence they
couldn't believe it.
“We were thoroughly disgusted,” Mike said.
49 News has made the decision not to use the parent’s
last name for fear of identifying the victim.
A jury found Orlando Paul Cicneros guilty on 17 counts.
"17 felony counts of rape and all these horrible
charges against a minor and they walk free,” Mike said.
Their child was raped and sodomized...
“Our daughter didn't get any justice and she's still
just 14. She's just a girl,” said her mother, Tina.
Judge Matthew Dowd sentenced Cicneros to just three
years- of probation.
“For the judge to say three years probation, it's like,
we were floored. Why would he do that?” Tina asked.
Members of the community couldn't believe it either.
Monica Breedy didn't know Mike and Tina, or their daughter, but she was
outraged. She has two small children of her own.
"As a parent I want to know the community I'm choosing
to raise my children in is going to be safe,” Brede said.
So, Breede is organizing a protest of Judge Dowd's
actions.
“I think it's very important for the community to know
they can take action and make a point,” Breede added.
And Mike and Tina say they won't stop until they
finally get justice for their little girl.
“I'm not gonna give up. I'm going to see this through
until the end,” Mike said.
Mike and Tina are waiting for an appeal in the case.
They hope it will lead to a longer sentence for Cisneros, and in the meantime,
they hope the pressure will lead to Judge Matthew Dowds' resignation.

Today, I am writing in regard to Shawnee County (KS)
District Judge Matthew Dowd's decision to grant
probation to a man convicted of sexually assaulting a
14-year-old girl
What was this judge thinking?
Apparently, he cares more for the sick criminal than the victim in this case.
His decision has dredged up memories from my childhood that I had long ago
buried. Memories of when I was molested somewhere around the tender age of 11 or
12. Back then, no one listened to me, not even my parents, so I buried the
memories.
What Dowd did was refuse to listen to this little girl, the same as those around
me as a kid did, when I was hurt.
Kansas sentencing guidelines say that this molester could have been sentenced to
almost 13 years in jail, but Dowd chose to ignore that and gave him probation.
With judges like this, it is no wonder so many people consider taking the law
into their own hands.

year old girl, and he gets 3 years (that is 36 months for you public school
graduates) of PROBATION - just to make it clear, he gets not one night in the
pokey for repeatedly raping a 14 year old girl.

Sentences meted out to convicted sex offenders by a
Shawnee County judge have angered relatives of the young victims and at least
one juror, who voted to convict a man of 17 charges only to see him granted
probation.
But there is no realistic chance critics of District
Court Judge Matthew Dowd can force out the courtroom veteran for granting
probation to a man guilty of repeatedly raping and sodomizing a teenager.
Dowd is scheduled to be on the countywide retention
ballot in November 2008, but it has been nearly 30 years since a district judge
in Kansas lost one of those retention votes. It all may be a moot point, given
Dowd's plans to sidestep the voters' upcoming job evaluation by retiring before
the election.
There is no mechanism in Kansas to petition for recall
of a district court judge.
The Kansas Supreme Court has authority to oust a
wayward judge, but only if evidence exists of an egregious ethics violation. No
such charge is pending against Dowd.
"Wow," said House Judiciary Committee Chairman Mike
O'Neal, R-Hutchinson, said Monday. "Wow."
O'Neal's reaction was to Dowd granting probation for
Orlando Paul Cisneros, 38, who was convicted by a Shawnee County jury on 17
charges of rape and sodomy involving a 14-year-old girl. The May 25 ruling was a
departure from state sentencing guidelines recommending Cisneros serve 13 years
in prison.
Dowd's decision took Topeka by surprise. The victim's
father railed against Dowd, claiming "he let a rapist out on the street."
Another recent case raising eyebrows involves Dowd's
placement of Federico Mendoza, 34, on probation for soliciting sex from what he
thought was a 13- or 14-year-old girl found via an Internet chat room. He could
have been sentenced to 12 years in prison.
O'Neal said the fledgling state Judicial Performance
Commission, of which he is a member, may offer the best solution for Kansans
worried about decisions from the bench. The 13-member panel is creating a survey
and rating system capable of helping voters make more educated ballot decisions
about members of the judiciary.
The commission created by the 2006 Legislature is
directing its attention to the Kansas Supreme Court, Kansas Court of Appeals,
district courts and magistrate courts. The grading system in expected to be in
place by the 2008 elections.
In terms of district court judges, information would be
shared with the public in places such as Shawnee County — which relies on
nonpartisan merit selection of judges by the governor followed by countywide
retention votes — as well as in jurisdictions where judges are elected through
regular partisan balloting.
"People will have more information than they've ever
had before," O'Neal said.
Johnson County political activist Tim Golba said the
time had come to dispense with appointment of judges. The legal community has
too much influence on the selection process and the public doesn't pay attention
to judicial retention questions, he said.
Golba is involved in the campaign to convince Johnson
County voters to switch to the pure election system used in Wyandotte and
Sedgwick counties. Johnson County residents will vote on the question in 2008.
"It's time the people have a voice about who goes on
the bench," Golba said. "If a judge cannot be fair, he should not be on the
bench."
Rep. Harold Lane, D-Topeka, said the current system of
merit appointment has served Shawnee County reasonably well, but he wouldn't
object if voters in the county wanted to consider an alternative. "Either way
would be OK," he said.
The judicial performance commission ought to be given
an opportunity to have an influence before Shawnee County contemplates election
of district court judges, said Rep. Lana Gordon, R-Topeka.
"We need to be more informed," Gordon said. "We, as the
public, are not voting in the most informed way on judges."
Nancy Kirk, a member of the Topeka Unified School
District 501's school board and a former Kansas House member, said nothing
should be done to undermine independence of Kansas' judiciary.
She said elections blur boundaries shielding judges
from special interests.
"You want people who don't have to be looking at their
backs to make a decision," she said.

A Shawnee County District Court Judge is responding
to allegations that he goes easy on sexual predators.
We told you the story of Orlando Paul Cisneros last
week.
He was convicted of sexually assaulting a
14-year-old -- and was sentenced to probation by Shawnee County District
Court Judge Matthew Dowd.
The sentence would be controversial in and of
itself -- but Judge Dowd also sentenced another man, Federico Mendoza to
probation.
Mendoza solicited sex online
from someone he thought was a young girl.Judge Dowd said the two cases were separate, and
the timing of the sentences were coincidental.
He told us he reviewed the Cisneros case -- and
concluded he wasn't a danger to other young girls.
